Academic Software

Academic software is software sold at significantly discounted prices to students, faculty members and educational institutions. Do not list academic copies of software on AussieROO unless you are authorised to do so as an educational reseller, an educational institution, a student or a faculty member.

On AussieROO, please do not list any academic software unless you are authorized to do so. Postings violating AussieROO academic software policy may be deleted prior to publication.

Sellers who want to find out if they are allowed to resell their academic software should start by looking at the software maker’s and also try to contact the software maker directly.

Under copyright laws, the owner of a copy of a copyrighted work is generally entitled to resell the particular copy they own. If a seller has licensed the right to use a particular copyrighted item (as is the case with most software), they should review the license and consult with a lawyer to determine whether they can resell the item.

Animals and Wildlife Products

Trade in wildlife products is a lucrative business and involves a wide variety of species, this trade has contributed to the decline in a number of species of animals and plants. The scale of over-exploitation of wildlife for trade led to an international treaty (CITES) being drafted in 1973 to prevent international trade from threatening species with extinction. Many animal parts are used in the manufacture of clothing, food, traditional medicines, hunting trophies, souvenirs and collectibles. CITES has established a world-wide system of controls on international trade which are administrated in Australia by the Department of Environment and Heritage. Species that are the most endangered among CITES-listed animals and plants are prohibited on AussieROO. Species protected under Australian and International conservation laws,

Anti-Circumvention Policy

Do not list any hardware and software that would enable users to "duplicate" or otherwise make unauthorised copies of copy-protected video games, software programs, CD-ROMs, DVDs, or CDs.

Artifacts, Aboriginal and Torres Strait Islander items

Many artifacts and heritage items are protected under federal laws, for example, the Historic Shipwrecks Act 1976, the Aboriginal and Torres Strait Islander Heritage Protection Act 1984 and the Protection of Movable Cultural Heritage Act 1986. AussieROO will co-operate with Department of Environment and Heritage and other relevant agencies in determining what items may lawfully be traded.

Aboriginal and Torres Strait Islander objects—Any human remains of Aboriginal or Torres Strait Islanders, items considered sacred by Aboriginal or Torres Strait Islander persons and gravesite/burial related items may not be traded on AussieROO.

Aboriginal artefacts—Artefacts taken from any federal, state, public, declared Aboriginal area or land, or items which are otherwise declared objects under the Aboriginal and Torres Strait Islander Heritage Protection Act, is prohibited from trading.

Export of Cultural Heritage Items—The Protection of Movable Cultural Heritage Act 1986 controls the export of the most significant aspects of Australia's movable cultural heritage. The Act is not intended to restrict an individual's right to own or sell within Australia. It implements a system of export permits for certain heritage objects defined by the Act as 'Australian protected objects'.

Historic shipwrecks artefactsThe transfer, possession and custody of relics or artefacts, including coins, from historic shipwrecks, are regulated under the Historic Shipwrecks Act 1976. Historic shipwreck relics are protected even if you came into possession of this material long before the Historic Shipwrecks Act existed.

Permits are required before selling or otherwise disposing of a shipwreck relic. Permits should be obtained from the Delegate in your State.

Export of shipwreck relics such as coins from Australia without a permit is prohibited by the Historic Shipwrecks Act. Shipwreck relics are also considered to be Australian protected objects, and cannot be taken from the country or sent overseas without a permit under the Protection of Movable Cultural Heritage Act 1986.

Contracts and Tickets

Before posting an item on AussieROO, you should carefully read any contracts that you have entered into that might limit your right to promote your item on AussieROO. Some items, such as airline tickets, have terms printed on the item that may limit your ability to sell that item. In other cases, such as when you are distributing a company's products, you may have signed a separate contract restricting your ability to market the product.

AussieROO does not search for items that may raise these types of issues, nor can it review copies of private contracts, or adjudicate or take sides in private contract disputes. However, we want you to be aware that posting items in violation of your contractual obligations could put you at risk with third parties. AussieROO therefore urges that you not list any item until you have reviewed any relevant contracts or agreements, and are confident you can legally promote it on AussieROO.

We provide this information to assist you in protecting yourself from liability and trading safely on AussieROO. You are responsible for ensuring that your transaction is lawful. If you have any questions regarding your rights under a contract or agreement, we strongly recommend that you contact the company with whom you entered into the contract and/or consult with a solicitor or lawyer.

Counterfeit Currency and Stamps

AussieROO strictly prohibits the sale and purchase of counterfeit currency and stamps, coins, bank notes, bonds, money orders, and other securities, as well as equipment designed to produce such illegal items.

Any "reproduction," "replica," or "copy" coin as a collectible item must be clearly marked with the word COPY, REPRODUCTION or REPLICA. Only under this stipulation, such reproduction coins are permitted.

The trading of counterfeit currency and stamps, along with equipment designed to make these items violates Australian federal law, and is strictly forbidden on AussieROO. These laws ban not only counterfeit paper money, but also counterfeit coins, bank notes, bonds, money orders and other securities. Australian law also protects foreign currency and stamps from counterfeiters. Therefore, these counterfeit items may not be listed on AussieROO.

Counterfeit Items

Trading or promoting counterfeit, replica or unauthorized items and accessories is strictly prohibited on AussieROO.

Counterfeits, unauthorised replicas, unauthorised items (such as counterfeit DVD’s, watches, handbags, or other accessories) or unauthorised copies (such as copies of software programs, video games, music albums, movies, television programs, or photographs) are not permitted on AussieROO. Unauthorised copies include; copies that are pirated, duplicated, backed-up and copied. It is illegal to sell unauthorised copies of media.

AussieROO urges trading partners to comply with all governmental laws and regulations. Since the sale of counterfeit items, unauthorised replicas and unauthorised copies is prohibited by law businesses may not list these items on AussieROO. This policy helps protect trading partners from purchasing counterfeit or fraudulent items, helps protect intellectual property rights owners against infringement, and helps create a safer E-Marketplace.

Posting offering to sell or buy replica, counterfeit or otherwise unauthorized items shall be terminated upon acknowledgement by AussieROO. Multiple violations of AussieROO’s counterfeit items policy shall result in the suspension of your membership.

Drugs and Drug Paraphernalia

The sale of prohibited drugs and drug paraphernalia is strictly forbidden on AussieROO, and violates state, federal and international law. AussieROO strongly supports law enforcement and urges the prosecution of those responsible for knowingly attempting to sell such items on AussieROO.

Prohibited drugs or plants, and other controlled substances may not be listed on AussieROO. This includes drugs, plants and substances outlined in Schedule 1 of the New South Wales Drug Misuse and Trafficking Act 1985 and the Commonwealth Crimes (Traffic in Narcotic Drugs and Psychotropic Substances Act 1990.

Drug paraphernalia, as defined in the New South Wales Drug Misuse and Trafficking Act 1985, may not be listed on AussieROO. Such paraphernalia includes all items that are primarily intended or designed for use in manufacture or use of a prohibited drug.

Event Ticket Resale Policy

AussieROO permits the resale of tickets to entertainment events (including sporting events, concerts, and plays) to the fullest extent permitted by law.

However, AussieROO cannot give you legal advice on your ticket transactions, and you should be aware that there may be laws (such as laws of local municipalities that require resellers to obtain licenses) that may apply to your transaction. The information provided here is simply provided to you as a starting point for your research. As a ticket seller, you are responsible for ensuring that your particular transaction does not violate any applicable law or the terms on the ticket itself.

Faces, Names and Signatures

Do not list items containing the image, likeness, name, or signature of another person unless the products were made or authorized by that person.

Postings violating AussoeROO's Faces, Names and Signatures Policy may be deleted early by AussieROO.

Financial Services

AussieROO prohibits the providing of financial services, including money transfers, issuing bank guarantees and letters of credit, loans, fundraising and funding for personal investment purposes, etc.

Firearms, Ammunition, Replicas, and Weapons

Any firearms, ammunition, military ordinance, assault weapons, and related parts or accessories are not permitted on AussieROO. The trading and promoting of firearms, ammunition, weapons to and from countries in which they are illegal is strictly prohibited and such activity will result in your account being cancelled.

AussieROO does not permit the sale of BB guns, air guns, black powder guns or muzzle-loader guns and stun guns. Replica, "look-alike," and imitation firearms under certain circumstances will be permitted only upon the expressed approval of AussieROO. Such replica and imitation items must have clear markings permanently affixed to the items to the extent required by the laws of applicable jurisdiction, and must not be readily convertible to shoot a project.

Weapons of Mass Destruction (WMD) and any instruction, processing, or aid of producing such weapons or materials is strictly prohibited by international law. Any violation of this policy will result in the notification of government authorities by AussieROO.

Knives and other cutting instruments will in most cases be permitted to be listed. Switchblade knives and disguised knives are not permitted on the AussieROO site. AussieROO maintains discretion over what items are appropriate and may cause removal of a listing that it deems as a weapon.

Fireworks

Fireworks or pyrotechnic devices may not be listed on AussieROO. These items are heavily regulated or banned in Australia under the Dangerous Goods Act 1975 (NSW). All fireworks contain explosive substances and are therefore classified as Dangerous Goods.

Under Australian law, fireworks means an article designed to produce a sound or pyrotechnic signal or a pyrotechnic effect by the explosion or ignition of an explosive substance. Pyrotechnic devices include "any combination of materials, including pyrotechnic compositions, which, by the agency of fire, produce an audible, visual, mechanical or thermal effect designed and intended to be useful for industrial, agricultural, personal safety, or educational purposes."

Devices that may not be listed on AussieROO include, but are not limited to: fireworks and fireworks kits, aerial bombs, bungers, booby traps (pull string), bottle rockets, chasers, daygo bombs, firecrackers, fountains, nitro poppers, party poppers, roman candles, skyrockets, smoke balls, smoke bombs, snap caps, snappers, sparks, and torpedoes.

Gaming Devices

Legislation in Australia prohibits the possession, the sale, exchange or attempted sale, without a license (issued by the governing body for gaming in their home state) of the following:

  • A gaming or an amusement device that is designed for the playing of a game of chance,
  • or a game that is partly a game of chance and partly a game requiring skill.

This includes devices

  • capable of the paying out of money or tokens
  • or for registering a right to an amount of money or money's worth to be paid.

The legislation extends to and includes any subsidiary equipment or component of a gaming device. Common items that fall within this category include Poker and Bingo Pinball Machines and accordingly these items will not be permitted for sale on AussieROO.

Government Identification and Licenses

The following items may not be listed on AussieROO:

  • Items that claim to be, or appear similar to, official government identification documents or licenses, such as birth certificates, drivers licenses, visas or passports. Furthermore, completed applications for such documents containing personal information may not be listed.
  • Fake identification cards, or any items that are designed for the manufacturer of such cards.

Hazardous Materials

Hazardous or dangerous materials (such as explosives, radioactive materials, flammable gases, liquids and solids, and toxic substances) are not permitted on the AussieROO site.

Human Parts & Remains

Humans, the human body, or any human body part may not be listed on AussieROO. Examples of prohibited items include, but are not limited to: organs, bone, blood, waste, sperm, and eggs.

Exceptions: Items made of human hairs, such as wigs for commercial uses, are permitted.

Invoices

The sale of any form of invoices, including but not limited to value added invoice, is strictly prohibited on the AussieROO site.

Pornographic Materials or Adult Materials

Pornographic materials are not permitted on AussieROO, as they violate laws in many countries. While Pornography is difficult to define and standards vary from nation to nation, Under Australian law it may be a criminal offence for you to buy or sell certain types of publications, films and computer games. The Classification (Publications, Films and Computer Games) Act 1995 sets out guidelines for the classification of these items. In general publications, films and computer games that are classified RC (refused classification) or X are considered by the authorities to be indecent. You may be committing an offence by trading or promoting such items on AussieROO.

AussieROO strictly prohibits items depicting bestiality, rape sex, incest, or sex with graphic violence or degradation.

AussieROO’s site is used by people all over the world. However, many countries have laws regulating adult material that are quite strict, and the law regulating the sale of such items through the Internet across national borders is an unsettled issue.

The majority of the reports received concerning adult/sexually-oriented material are related to magazines and videos. Whether to transfer such items to another category or remove them completely from the site, we consider the overall content of the posting, including photos, pictorials, and text.

AussieROO does not permit the sale of SM products. Novelty sexually explicit items, including various types of toys, collectibles, or food items in the shape of genitalia and primarily intended for adult buyers are permitted in the appropriate category.

It is illegal to have CHILD PORNOGRAPHY in your possession. Any such item listing that is brought to AussieROO's attention will be ended immediately and the relevant information referred to the proper authorities, by law.

Items containing adult language may also be ended. The use of profanity is generally not permitted within item descriptions or titles in the open area, even if it is part of the item's title (such as with some CDs or movie titles.)

Posting an Ad for the Sole Purpose of Collecting User Information or Raising Money

AussieROO is the ideal site for business to business commercial transactions. Honesty, integrity and high ethical standards are what we represent. Postings on this site should clearly represent the item being sold. If your objective is otherwise, we ask that you seek out other websites to carry on the business activity you seek to perform.

Police, Emergency Services, Security & Military - Related Items

With limited exceptions (partially listed below), AussieROO does not permit the listing of law enforcement or emergency services badges or equipment from any public entity, including badges issued by the government of any country. This prohibition extends to police badges and official equipment from federal, state or local law enforcement agencies of Australia and New Zealand.

Emergency services and law enforcement agencies generally prohibit any commercial reproduction of their name, seal or logo. Therefore, copies or reproductions of military, emergency services or law enforcement emblems may be ended. Such items infringe upon the copyright and trademark rights of the agency that owns the emblem.

Prescription Drugs and Devices

AussieROO does not permit the posting of any controlled drug or item that requires a prescription from a licensed practitioner (such as a doctor, dentist, or optometrist) to dispense. Certain drugs, such as insulin, come in prescription and non-prescription forms. Such drugs may also be prohibited. If you are uncertain as to the permissibility of your item, please contact AussieROO prior to posting.

AussieROO also does not permit unauthorised medical devices.

Mailing Lists and Personal Information

AussieROO does not permit the sale of bulk email or mailing lists that contain names, addresses, phone numbers, fax numbers or other personal identifying information. Any tools or software designed to send unsolicited commercial email ("spam") will not be permitted.

AussieROO does not permit postings that present personal information of third parties such as addresses and telephone numbers.

Misleading Titles

Businesses are not permitted to create titles for their listings that do not accurately describe the items available.

Non-business Information

AussieROO is the online business to business information platform; personal and non-business information is not acceptable.

Offensive Material

Businesses may not list items that promote or glorify hatred, violence, racial or religious intolerance, or items that promote organisations with such views.

Satellite and Cable TV Descramblers

AussieROO does not permit the sale of items that can be used to descramble or facilitate the access to cable or satellite television programming without authorisation or payment. Stating the item is for educational or test purposes will not legitimise a product that is otherwise inappropriate.

Information on "how to" descramble or gain access to cable or satellite television programming without authorisation or payment is similarly not allowed. AussieROO policy also prohibits the "encouragement" of this type of activity. If your item is marketed in such a manner, the listing may be ended early by AussieROO.

Some examples of items, which are not allowed, include:

  • Smart Card Programmers and Unloopers
  • Programmed Smart Cards
  • Blocker Devices
  • Hardware or Software DSS Emulators

Desktop Pay television receivers in most instances remain the property of the Pay Television provider and are not able to be onsold by businesses. Therefore, these types of units will not be allowed to be listed on AussieROO

Spying and Electronic Surveillance Equipment

AussieROO does not permit the sale of products that are designed primarily to record the private oral, wire, or electronic conversations of others without their knowledge or permission. These items (for example, small, easily hidden transmitting devices such as telephone "bugs", "wiretap" devices, "miniature transmitters", and "surveillance microphones") are illegal to possess or sell under the Crimes Act 1914(Cth), and their use also violates the law in many states and countries.

Several states (including NSW) prohibit the use of photographic devices to surreptitiously view or record individuals for sexual purposes. Listings that promote such activity are not permitted on eBay.

Stocks and Other Securities

The sale of stock or other securities is not permitted on AussieROO.

Examples of items not allowed on AussieROO:

  • All stocks, bonds, and investment interests in any entity or property, including but not limited to corporations or partnerships, other than the exceptions permitted below for cancelled certificates and single-share gifts.
  • Credit (for example, you may not sell $1000 in credit to a buyer).
  • Solicitations to invest money in any business venture.
  • Any portion of an ongoing business.
  • 100% of any ongoing business if the sale involves a transfer of any stock in that business.
  • Documentation that represents proof of a current investment interest in any entity.
  • Notes (except as specifically permitted under our Real Estate Rules).

Some business-related items are not "securities" and may be listed on AussieROO. Examples of items that can be sold:

  • 100% of the assets of a business (inventory, lease, good will) where no transfer of stock is involved.
  • Information about how to start a business.
  • Any sale of inventory, leases, fixtures.
  • "Turn key" businesses such as vending machines or windshield repair kits.
  • Tools used for a business, such as silk screening machines or photo mug equipment.
  • Websites or domain names.
  • Old or collectible stock certificates, provided that such stock certificates are cancelled or represent an interest in an entity that no longer legally exists.
  • Single-share stock certificates marketed for gift purposes rather than investment purposes, provided that the certificates are marked and advertised as non-transferable, the ownership is not transferred into the name of the purchaser, and the minimum sale price is more than twice the current exchange trading price of the underlying single share security.

Stolen Property

AussieROO strictly forbids the sale of stolen property. AussieROO strongly supports law enforcement efforts to recover stolen property that is listed on its Web site, and urges the prosecution of those who knowingly attempt to sell such items on AussieROO.

Theft of Property: If members see an item on AussieROO that they believe is stolen, the best course of action is to contact law enforcement immediately. AussieROO will ask that members inform the police officer handling the case that AussieROO will be pleased to cooperate in the investigation, and ask the officer to contact AussieROO using established communications channels. The officer should include all relevant information.

If you are concerned that the images and/or text in your business listing or product catalogue has been used by another AussieROO user without your authorisation, or that your intellectual property rights have been violated by such user, please contact our service team.

Unauthorised Copies of Intellectual Property

Pirated recordings are unauthorised recordings of concerts or live performances.

Do not list unauthorised (pirated, duplicated, backup, bootleg, etc.) copies of software programs, video games, music albums, movies, television programs, or photographs on AussieROO.

Bands, performers, writers and publishers usually own the copyright to live performances, and thus have the right to determine when and how performances can be reproduced. Unless a copyright owner has authorised the reproduction of a concert or performance, it is considered an unauthorized or “pirated” copy. Trading unauthorised copies is both against the law and against AussieROO policy.

Weapons and Knives

Weapons listed on AussieROO Australia must comply with the relevant legislation including but not limited to the Weapons Prohibition Act 1998 (NSW). If a weapon does not comply with the relevant legislation, it is not permitted on AussieROO. The following list contains general guidelines for listing weapons and knives on AussieROO Australia.

Veterinary Products and Drugs for Animals

Certain drugs prescribed for animals will require a distribution license. For example, many heart worm medicines (such as Sentinel, Revolution, Heartguard and Interceptor) can only be purchased with a prescription, and these items are therefore not allowed on AussieROO.

However, a number of flea control products (such as Program, Advantage and Top Spot) can be bought and sold without a prescription, and therefore may be listed on AussieROO.
